1. Acceptance of Terms
By downloading, installing, or using the Home Inspection Report Builder (HIRBuilder) application (“the App”), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
2. Description of Service
HIRBuilder is a mobile and desktop application designed for professional home inspectors. The App provides tools for conducting inspections, recording findings, capturing photos, generating reports, and syncing data across devices.
3. User Accounts
You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
4. Subscription and Payments
Some features of the App require a paid subscription. Subscription fees are billed in advance on a recurring basis (monthly or annually). You may cancel your subscription at any time, but refunds are not provided for partial billing periods. Prices are subject to change with reasonable notice.
5. User Data and Content
You retain ownership of all data and content you create using the App, including inspection reports, findings, photos, and notes. You grant us a limited license to store and process your data solely to provide the service. You are responsible for ensuring your inspection data is accurate and complete.
6. Acceptable Use
You agree not to: (a) use the App for any unlawful purpose; (b) attempt to gain unauthorized access to the App or its systems; (c) share your account credentials with unauthorized parties; (d) reverse engineer, decompile, or disassemble the App; (e) use the App in any way that could damage or impair the service.
7. Device Limits
Each account may be used on up to 3 active devices simultaneously. Adding a device beyond this limit will automatically deactivate the oldest device. You can manage your active devices from the Settings screen.
8. Disclaimer of Warranties
The App is provided “as is” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is a tool to assist inspectors and does not replace professional judgment. You are solely responsible for the accuracy and completeness of your inspection reports.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
10. Data Loss
While we take reasonable measures to protect your data, we are not responsible for data loss due to device failure, software errors, or other circumstances. We recommend maintaining regular backups of your important inspection data.
11. Termination
We may suspend or terminate your account if you violate these terms. Upon termination, your right to use the App ceases immediately. You may request export of your data within 30 days of termination.
12. Changes to Terms
We reserve the right to modify these terms at any time. We will notify you of significant changes through the App or via email. Continued use of the App after changes constitutes acceptance of the modified terms.
